Supreme Court upholds manslaughter conviction
BISMARCK – The North Dakota Supreme Court has rejected the appeal of a Minot man convicted of manslaughter and reckless endangerment with a firearm in a Minot bar shooting.
Travis McDermott was convicted in the May 2023 death of Greyson Sletto. North Central District Court Judge Todd Cresap sentenced McDermott, 41, last May to serve 10 years with the North Dakota Department of Corrections and Rehabilitation for manslaughter, with a requirement to serve seven years,and with credit for 409 days already served plus good time. For the count of reckless endangerment, McDermott was sentenced to serve a concurrent sentence of five years and complete three years of supervised probation upon his release.
McDermott appealed the jury verdict, arguing the district court committed an obvious error by failing to declare a mistrial after some of the jury pool allegedly observed him in restraints prior to questioning of the jury candidates during the selection process.
The Supreme Court unanimously determined McDermott waived his claim of error when he raised the issue with the court but then withdrew any objection, stating he wished to move forward with the trial.
