Sentence follows drug-related guilty plea

A Minot man has been sentenced to time served and probation after pleading guilty to Class B felony possession of fentanyl with intent to deliver and a Class C felony charge for paraphernalia possession.

Dakota Richard Nelson, 28, Minot, appeared on Jan. 10 before North Central District Court Judge Douglas Mattson in Minot for his sentencing. Nelson was charged in May 2023 after he was detained during an investigation into a stolen bike.

According to court documents, Nelson was searched by responding officers who found multiple tubes with burn residue and another containing crushed powder and about 49 blue pills. Nelson told police the pills were fake “Roxies” and they were pressed in Minot and sold for about $30.

Mattson gave Nelson a concurrent sentence of five years in the Department of Corrections and Rehabilitation, to first serve four days with credit for time already served. Nelson was ordered to complete three years of supervised probation and must complete a chemical dependency evaluation.

Nelson was further required to give two presentations before a Narcotics Anonymous group locally or within the region. The paraphernalia charge will be deemed a misdemeanor pending the fulfillment of probation conditions.

Nelson was assessed $1,000 in court fines and fees.
