Minot man sentenced for terrorizing, domestic violence
A Minot man has been sentenced to consecutive sentences that will have him serving several months in prison after pleading guilty to two Class C felonies.
Dylan James Vivier, 27, Minot, was charged in April of last year with one count of terrorizing an adult victim and one count of domestic violence causing serious bodily injury. According to the probable cause affidavit, police were called to a Minot residence after a female victim flagged down a neighbor asking for help. The victim identified Vivier as her attacker to police, saying he struck her five times in the head with a hammer.
Vivier appeared in North Central District Court on Tuesday before Judge Stacy Louser to enter his change of plea to guilty. Louser gave Vivier consecutive sentences for the two counts.
For the terrorizing charge, Vivier was ordered to serve five years in the Department of Corrections and Rehabilitation, with all but 275 days suspended, and he will be required to complete three years of supervised probation upon release. Vivier was sentenced on the domestic violence charge to five years in the DOCR and must serve 18 months, with credit for the 275 days to be served for the first count. Vivier must complete three years of supervised probation upon release and must complete a domestic violence course and chemical dependency evaluation.
Restitution is pending a possible hearing that must take place within 60 days of the disposition.
Vivier was assessed $1,100 in court administrative and indigent recoupment fees.
