Minot man arrested, charged with murder

Charles Crane/MDN Justin McDermott speaks with his attorney Philip Becher outside courtroom 301 in the Ward County Courthouse after his initial appearance for AA felony murder charges on Friday.

UPDATE: Minot Police on Saturday identified the victim as Kenny C. Javar, 36, Minot.

Justin McDermott, 34, Minot, has been arrested and charged with AA felony murder after an incident at 200 16th St. SW in Minot.

The Minot Police Department said in a release that they arrived at the address in response to reports of gunshots at 1:40 a.m. on Friday, discovering a 36-year-old male victim with multiple gunshot wounds. The victim was pronounced dead at the scene.

According to the release, the incident in a parking lot was witnessed by multiple business patrons, with two individuals disarming McDermott and detaining him until police arrived. McDermott is being held in the Ward County Jail and made his initial appearance in North Central District Court in Minot on Friday.

The Ward County state’s attorney asked the judge for a $1 million bond, citing the victim’s six gunshot wounds and additional ammo that was allegedly on McDermott’s person at the scene. The prosecution also asked for a no contact and distance order to protect the victim’s family, saying that so far there is no evidence of a prior relationship between McDermott and the victim, but that it is possible they may live in the same neighborhood.

The victim was referred to as John Doe by the court, as his family lives out of state and is still being notified about his death. The victim’s wife spoke to ask the court for as high a bond and as restrictive bail conditions as possible.

Judge Stacy Louser ultimately handed down a $2 million cash or corporate surety bond, restricting McDermott from consuming alcohol and requiring that all weapons and ammunition in his home be turned in to authorities. Louser also imposed a 150-foot distance and no contact order but afforded the prosecution and the victim’s family some time to decide on deferring a Marsy’s Law election.

McDermott’s preliminary hearing is scheduled for Feb. 3, and the pretrial conference is scheduled for April 12.

Starting at $2.99/week.
