NOTICE IS HEREBY GIVEN that
the City of Minot (Owner) is re-
questing Bids for the construction of
the following Project: 2021 Water
Main Replacement.
Bids for the construction of the Pro-
ject will be received at the office of
the City Clerk located at 515 Second
Avenue SW (Second Floor), Minot,
North Dakota 58701, until Tuesday,
April 13, 2021 at 11:00 AM local
time. At that time the Bids received
will be publicly opened and read.
The Project includes the following
Work: Water main replacement (6″,
8“, 10” & 12″), asphalt removal, as-
phalt paving, pipe bursting water
main, installing gate valves, instal-
ling hydrants, reconnecting water
service lines, concrete sidewalk re-
placement, concrete driveway re-
placement, ADA ramps, concrete
curb & gutter, traffic control,
landscaping, and other related work.

Each bid must be accompanied by a
separate envelope containing the
bid security in a sum equal to five
percent of the full amount of the bid
and must be in the form of a bidder’s
bond. A bidder’s bond must be exe-
cuted by the bidder as principal and
by a surety, conditioned that if the
principal’s bid is accepted and the
contract awarded to the principal,
the principal, within ten days after
notice of the award, shall execute a
contract in accordance with the
terms of the bid and the bid bond,
and any condition of the City of
Minot, as required by law. A counter-
signature of a bid bond is not re-
quired. If the City of Minot elects to
award a contract to the lowest
responsible bidder, and the lowest
responsible bidder does not execute
a contract within the ten days al-
lowed, the bidder’s bond must be
forfeited to the City of Minot and the
project awarded to the next lowest
responsible bidder.
Each bidder must possess a valid
North Dakota contractor’s license for
the full amount of their bid, as re-
quired by Section 43-07-07 of the
North Dakota Century Code. Each
bidder MUST enclose a copy of their
Contractor’s License or Certificate of
Renewal, issued by the North Dako-
ta Secretary of State, in their bid
bond envelope, and each license
must be valid and dated at least 10
days prior to the date set for bid
opening, as required under Section
43-07-12 of the North Dakota Centu-
ry Code.
No bid may be read or considered if
it does not fully comply with the re-
quirements of Section 48-01.2-05 of
the North Dakota Century Code, and
any deficient bid submitted will be
resealed and returned to the bidder
immediately.
All Bids submitted and all Work
completed must be as stipulated in
the Agreement.
The City of Minot reserves the right
to hold all Bids for a period of 30
days after the date of the bid open-
ing, to reject any or all Bids and to
rebid the project until a satisfactory
bid is received, and to waive any in-
formality or irregularity in any Bid.

Generally, the Work covered by the
Plans and Specifications for the 10th
Street N Improvements consists of
the materials, labor, tools, and
equipment required for topsoil strip-
ping, excavation and embankment
work, 2900 SY of Cement Stabilized
Subgrade, 1100 Ton of Aggregate
Base, 600 Ton of FAA 43 Super-
pave Hot Mix Asphalt, 100 SY 6″
Reinforced Concrete Pavement, 730
SY Concrete Sidewalk, Curb &
Gutter and other incidentals as iden-
tified in the Plans and Specifications.
A bid alternate will be available that
removes the Cement Stabilized
Subgrade and includes an additional
1100 Ton of Aggregate Base.
All Bids are to be submitted on the
basis of cash payment for the Work
and Materials, and are to be en-
closed in a sealed envelope ad-
dressed to the City of New Town,
PO Box 309, accompanied by a
separate envelope containing a
Bidder’s Bond in the sum equal to
5% of the full amount of the Bid, ex-
ecuted by the Bidder as Principal,
and by a Surety, conditioned that if
the Principal’s Bid is accepted and
the contract awarded to the Princi-
pal, the Principal, within ten days
after notice of award, shall execute a
Contract in accordance with the
terms of the Bid and Performance
and Payment Bonds as required by
the law and the regulation and deter-
minations of the Owner. If a suc-

Generally, the Work covered by the
Plans and Specifications for the Gol-
dade Lift Station Replacement con-
sists of the materials, labor, tools,
and equipment required for the con-
struction a sanitary sewer lift station.
The Work includes the removal and
replacement of a sanitary sewer lift
station, two sanitary manholes, ap-
proximately 110 LF of gravity sani-
tary sewer, and approximately 65 LF
of sanitary sewer force main. The
Work shall also include the removal
and replacement of approximately
50 LF of curb & gutter, 35 SY of con-
crete sidewalk, 190 SY of asphalt
pavement, and other incidentals as
necessary to complete the project.
Details of the construction are in-
cluded in the Drawings and Project
Manual.
All Bids are to be submitted on the
basis of cash payment for the Work
and Materials necessary to complete
the project. Each bid must be ac-
companied by a separate envelope
containing the contractor’s license
and bid security. The bid security
must be in a sum equal to five per-
cent of the full amount of the bid and
must be in the form of a bidder’s
bond. A bidder’s bond must be exe-

rates, Section 3 employment plan,
not less than the minimum salaries
and wages as set forth in the Con-
tract Documents must be paid on
this project, and that the Contractor
must ensure that employees and ap-
plicants for employment are not
discriminated against because of
their race, color, religion, sex, or na-
tional origin.
No Bid may be read or considered if
it does not fully comply with the re-
quirements of Section 48-01.2-05 of

The Owner reserves the right to hold
all Bids for 60 days, to reject any or
all Bids, to waive any informality or

Bid deemed in the best interest of

Should the Contractor fail to com-
plete its obligations under the Con-
tract within the time required herein
or within such extra time as may
have been granted by formal exten-
sions of time approved by the Own-
er, there will be deducted from any
amount due to the Contractor the
sum of $1,000 per day for each and
every calendar day that the comple-
tion of the Work is delayed. The
Contractor and his Surety will be li-
able for any excess. Such payment
will be as and for liquidated dam-
ages and not as a penalty.

NOTICE OF REQUIREMENT FOR
AFFIRMATIVE ACTION to EN-
SURE EQUAL EMPLOYMENT OP-
PORTUNITY
1. The Offeror’s or Bidder’s attention
is called to the “Equal Opportunity
Clause” and the “Standard Federal
Equal Employment Opportunity
Construction Contract Specifica-
tions” set forth herein.
2. The goals and timetables for
minority and female participation,
expressed in percentage terms for
the Contractor’s aggregate work-
force in each trade on all construc-
tion work in the covered area, are as
follows:

These goals are applicable to all of
the Contractor’s construction work
(whether or not it is Federal or
federally assisted) performed in the
covered area. If the Contractor per-
forms construction work in a geo-

established for such geographical
area where the work is actually per-
formed. With regard to this second
area, the Contractor also is subject
to the goals for both its federally in-
volved and non-federally involved
construction.
The Contractor’s compliance with
the Executive Order and the regula-
tions in 41 CFR Part 60-4 shall be
based on its implementation of the
Equal Opportunity Clause, specific
affirmative action obligations re-
quired by the specifications set forth
in 41 CFR 60-4.3(a) and its efforts to
meet the goals. The hours of minori-
ty and female employment and train-
ing must be substantially uniform
throughout the length of the contract,
and in each trade, and the Contrac-
tor shall make a good faith effort to
employ minorities and women even-
ly on each of its projects. The
transfer of minority or female em-
ployees or trainees from Contractor
to Contractor or from project to pro-
ject for the sole purpose of meeting
the Contractor’s goals shall be a vio-
lation of the contract, the Executive
Order and the regulations in 41 CFR
Part 60-4. Compliance with the
goals will be measured against the
total work hours performed.
3. The Contractor shall provide writ-
ten notification to the Director of the
Office of Federal Contract Compli-
ance Programs (OFCCP) within 10
working days of award of any con-
struction subcontract in excess of
$10,000 at any tier for construction
work under the contract resulting
from this solicitation. The notification
shall list the name, address, and
telephone number of the subcon-
tractor; employer identification
number of the subcontractor; es-
timated dollar amount of the subcon-
tract; estimated starting and comple-
tion dates of the subcontract; and
the geographical area in which the
subcontract is to be performed.
4. As used in this notice and in the
contract resulting from this solicita-
tion, the “covered area” is the State
of North Dakota, Mountrail County,
City of Parshall.
The Parshall Municipal Airport Au-
thority, in accordance with the provi-
sions of Title VI of the Civil Rights
Act of 1964 (78 Stat. 252, 42 U.S.C.
Section 2000d to 2000d-4) and the
Regulations, hereby notifies all
bidders or offerors that it will affirma-
tively ensure that any contract en-
tered into pursuant to this adver-
tisement, disadvantaged business
enterprises will be afforded full and
fair opportunity to submit bids in
response to this invitation and will
not be discriminated against on the
grounds of race, color, or national
origin in consideration for an award.
The requirements of 49 CFR part 26
apply to this contract. It is the policy
of the Parshall Municipal Airport Au-

The regular meeting of the Lewis
and Clark School Board was called
to order at 7:05pm in the North
Shore Plaza boardroom. Board

The refinancing of our (2014) 5 mil-
lion dollar bond was discussed. The
bonds were sold today with a con-
siderable reduction in interest. The
governing body of the District acted
on the foregoing resolution at a
properly notice meeting held in Pla-
za, North Dakota, on February 8,
2021 with the motion for adoption
made by Pank and seconded by
Brown, and roll call vote on the mo-

ing. Mr. Ritteman also discussed the
completion of work in NSP on Kari’s
law compliance. Berthold school is
still working on this.
Superintendent presented the pro-
posed calendar for 2021/22. After re-
view, motion was made by
Brown/Schilla to accept the 2021/22
school calendar as presented. All

Mr. Ritteman discussed the legisla-
tive bills that would impact the
school district.
Motion was made by
Engelhard/Deaver to accept the
resignation letter from Maci Abra-
hamson, Lewis and Clark- NSP, so-
cial studies teacher at the end of this
school year. All yes. MC.
Final audit report for 2019/20 was
presented. Motion by Brown/Pank to
approve the final audit of the
2019-20 school year. All yes. MC.
Extending the Family First Corona
Response Act (FFCRA) was dis-
cussed. Motion was made by Brown
Schepp to extend the FFCRA leave
to March 31, 2021. All yes. MC.
COVID discussion continued. Board
member Engelhard wants more
board involvement in the COVID is-
sue. He would like a plan developed
by the board for the next year. Board
president called for a special board
meeting to work on this.
The petition to negotiate was
presented by the teachers. Motion
by Brown/Pank that pursuant to
NDCC Section 15.1-16-10, the
Board of Lewis and Clark School
District recognizes as the appropri-
ate negotiating unit all employees
licensed to teach by the ESPB or
approved to teach by the ESPB and
employed primarily as classroom
teachers. All yes. MC.
Special board meeting was set for
Wednesday, February 24, 2021 at
7:00 pm in the NSP boardroom for
the 2nd step in the negotiating pro-
cess and to work on a plan for CO-
VID for next year.

BOARD MEETING
February 24, 2021
The special meeting of the Lewis
and Clark School Board was called
to order at 7:04 pm on Wednesday,
February 24, 2021 in the NSP
boardroom. Board members present
were Erickson, Brown, Pank,
Schepp, Deaver and Schilla. Also
present were Superintendent Ritte-
man, Principals Gerding, Jenkins,
Lahti and Hochhalter, Athletic Direc-
tor Brown and Business Managers
Liz Huus and Tammy Lindahl.
There are a few items on the agen-
da. First the board reviewed the peti-
tion from the teachers association.
Motion was made by Brown/Deaver
that the School Board has investi-
gated the petition filed by the Lewis
and Clark Education Association re-
questing that the association be
recognized as the representative or-
ganization fro the negotiating unit
and has determined that the Educa-
tion Association does represent a
majority of the teachers within that
unit. The Board recognizes the
Lewis and Clark Education Associa-
tion as the representative organiza-
tion for a minimum of one year be-
ginning February 24, 2021. All yes.

Discussion was held on negotia-
tions. The negotiating committee will
be Erickson, Schepp and Schilla.
Pank will be the alternate. President
Erickson will set up the Ground
Rules meeting with the Lewis and
Clark Education Association.
Second on the agenda were teacher
resignations. Motion was made by
Brown/Deaver to accept the resigna-
tion of Lewis and Clark-NSP 6th
grade teacher, Trisha Wheeling at
the end of this school year. All yes.

rived.
Motion was made by Deaver/Brown
to accept the resignation of Lewis
and Clark-Berthold English teacher,
Callie Cook at the end of this school

Last the board discussed the Lewis
and Clark Health and Safety and
Learning Plans for COVID. Motion
was made by Brown/Schepp to ac-
cept the Lewis and Clark Health and
Safety and Learning Plans as
presented and previously approved
11-16-2020. Discussion was held re-
garding the involvement of ND
Department of Health in the notifica-
tion of positive cases,
isolation/quarantine, close contacts
and return to school. All yes. MC.
