Any companies/teams/joint ventur-

ers planning to submit a bid are en-

couraged to have at least one

representative present at the pre-bid

conference.

Generally, the Work covered by the

Plans and Specifications for

Manhole Rehab – Minot Country

Club consists of the material, labor,

tools, and equipment required for the

cleaning, repair and lining of 16 –

72-inch dia. And 2 – 48″ dia. sanitary

manholes including removal of

manhole steps and replacement of

castings. Details of the construction

are included in the Drawings, Project

Manual, and the 2021 City of Minot

Standard Specifications and Details.

All Bids are to be submitted on the

basis of cash payment for the Work

and Materials necessary to complete

the project. Each bid must be ac-

companied by a separate envelope

containing the contractor’s license

and bid security. The bid security

must be in a sum equal to five per-

cent of the full amount of the bid and

must be in the form of a bidder’s

bond. A bidder’s bond must be exe-

cuted by the bidder as principal and

by a surety, conditioned that if the

principal’s bid is accepted and the

contract awarded to the principal,

the principal, within ten days after

notice of the award, shall execute a

contract in accordance with the

terms of the bid and the bid bond

and any condition of the governing

body. A countersignature of a bid

bond is not required under this sec-

tion. If a successful bidder does not

execute a contract within the ten

days allowed, the bidder’s bond

must be forfeited to the Owner and

the project awarded to the next

lowest responsible bidder. Bidders

must be licensed for the full amount

of the bid as required by section

43-07-12 of the North Dakota Centu-

ry Code.

No Bid may be read or considered if

it does not fully comply with the re-

quirements of Section 48-01.2-05 of

the North Dakota Century Code.

The Owner reserves the right to hold

all Bids for 30 days, to reject any or

all Bids, to waive any informality or

irregularity in any Bid, to accept the

Bid deemed in the best interest of

the Owner, and to rebid the project

until a satisfactory bid is received.

There shall be endorsed upon the

outside of the envelope containing

the Bid, the following:

1. “City of Minot, Manhole Rehab –

Minot Country Club, Project Number

4571”

2. The name of the person, firm, cor-

poration, or joint venture submitting

the Bid.

3. The Bidder’s Contractor’s License

or Contractor’s License Renewal

Number.

4. Acknowledgement of the Adden-

da, if any.

Any deficient Bid received will be

resealed and returned to the Bidder

immediately.

Work shall not commence until July

20, 2021 and all work shall be sub-

stantially complete by October 15,

2021. All work shall be completed

and ready for final payment in accor-

dance with the General Conditions

by October 30, 2021.

Should the Contractor fail to com-

plete its obligations under the Con-

tract within the time required herein

or within such extra time as may

have been granted by formal exten-

sions of time approved by the Own-

er, there will be deducted from any

amount due to the Contractor the

sum of $750 per day for each and

every calendar day that the comple-

tion of the Work is delayed. The

Contractor and his Surety will be li-

able for any excess. Such payment

will be as and for liquidated dam-

ages and not as a penalty.

There are two Presidential Executive

Orders that place further emphasis

upon the Title VI protections of race

and national origin. Executive Order

12898 ensures nondiscrimination

against minority populations by

discouraging programs, policies, and

activities with disproportionately high

and adverse human health or en-

vironmental effects on minority and

low-income populations. Executive

Order 13166 directs recipients of

Federal financial assistance that to

ensure compliance with Title VI,

they must take reasonable steps to

ensure that limited English proficien-

cy persons have meaningful access

to their programs.

In general, the Work included in the

Project includes the labor, materials,

tools, and equipment required to

construct MREFPP Phase BU1C

Burlington as fully depicted in the

Drawings and Technical Specifica-

tions for the Project. The project is

located within the City of Burlington,

North Dakota.

All Bids are to be submitted on the

basis of cash payment for the Work,

and are to be enclosed in a sealed

envelope addressed to the under-

signed Chairman, endorsed as re-

quired below. Each bid must be ac-

companied by a separate envelope

containing the contractor’s license

and bid security. The bid security

must be in a sum equal to five per-

cent (5%) of the full amount of the

Bid and must be in the form of a

bidder’s bond. A bidder’s bond must

be executed by the bidder as princi-

pal and by a surety, conditioned that

if the principal’s bid is accepted and

the contract awarded to the princi-

pal, the principal, within ten days

after notice of the award, shall exe-

cute a contract in accordance with

the terms of the Bid and the bid

bond and any condition of the

governing body. A countersignature

of a bid bond is not required. If a

successful bidder does not execute

a contract within the ten days al-

lowed, the bidder’s bond must be

forfeited to the governing body and

the project awarded to the next

lowest responsible bidder. The

bidder must be licensed for the full

amount of the bid as required by

Section 43-07-12 of the North Dako-

ta Century Code.

quirements of Section 48-01.2-05 of

the North Dakota Century Code. Any

deficient Bid received will be

resealed and returned to the Bidder

immediately.

The Owner reserves the right to hold

all bids for 75 days, to reject any or

all Bids and to waive any informality

or irregularity in any Bid and to ac-

cept the Bid deemed in the best in-

terest of the Owner. The Owner

reserves the right to rebid the project

until a satisfactory Bid is received.

The Work shall be substantially

complete by July 29, 2022. All Work

shall be complete and ready for final

payment in accordance with the

General Conditions by August 31,

2022.

Should the Contractor fail to com-

plete its obligations under the Con-

tract within the time required herein

or within such extra time as may

have been granted by formal exten-

sions of time approved by the Own-

er, there will be deducted from any

amount due to the Contractor the

sum of $5,000.00 per day (with no

suspension for winter work) for each

and every calendar day that the sub-

stantial or final completion of the

Work is delayed. The Contractor and

his Surety will be liable for any ex-

cess. Such payment will be as and

for liquidated damages and not as a

penalty.

Athletic Director Brown discussed

the basketball game protocols and

the start of the joint 7/8 BBB team.

Restructuring of our $5,000,000

2014 bond was discussed with the

lowering of interest rates. Mr. Ritte-

man has been in contact with the

bond bank and presented the paper-

work. Motion was made by

Pank/Engelhard to approve the

resolution which provides for the

sale of general obligation school

building refunding bonds. On roll

Motion was made by Schilla/Pank to

approve the resolution providing for

participation in the school bond

credit enhancement program. On roll

Mr. Ritteman discussed the new

federal Kari’s Law regarding 911

calls through the district phones.

This becomes effective in February,

2021. The phone systems need to

have an override for a child trying to

dial out and not knowing the code.

Engelhard/Schepp that the district

take the necessary steps to comly

with this law and to absorb the cost.

Mrs. Lahti reviewed the principal re-

port with the board.

A virtual Negotiations Seminar for

board members was discussed.

General

The Minot International Airport (Air-

port), located in the City of Minot,

Ward County, North Dakota, is re-

questing Statements of Qualifica-

tions for Professional Airport Plan-

ning and Environmental Consultant

Services at the Minot International

Airport for projects in the Airport

Capital Improvement Plan (CIP),

and others, as may be necessary

over a five-year term (2021-2026).

FAA Advisory Circular (AC)

150/5100-14E, Architectural, En-

gineering, and Planning Consulting

Services for Airport Grant Projects,

should be referenced. This AC pro-

vides guidance for airport sponsors

in the selection and engagement of

consultants. It also discusses ser-

vices that normally would be includ-

ed in an airport grant project, types

of contracts for these services, con-

tract format and provisions, and

guidelines for determining the rea-

sonableness of consultant fees.

Do not include estimated fees in the

RFQ submittal.

Rejection of Statements

No proposals shall be accepted

from, or contracts awarded to, any

person, firm, or corporation that is in

arrears to the Airport or City of

Minot, upon debt or contract or that

is a defaulter, as surety or other-

wise, upon any obligation to the Air-

port. Prospective firms may be re-

quired to submit satisfactory evi-

dence that they have the financial

resources to perform and complete

the work outlined in this RFQ.

Debarment

By submitting this proposal, the

prospective consultant certifies that

neither the company nor its princi-

pals are presently debarred,

suspended, in the process of de-

barment, declared ineligible, or

voluntarily excluded from participa-

tion in this transaction by any federal

department or agency.

Contract

The top-ranked firm will be invited to

negotiate a contract with the Airport.

A detailed scope of work will be

developed and agreed to by the

selected consultant and the Airport.

This detailed scope of work and the

associated fees will be part of the

contract.

The consultant shall not discriminate

on the basis of race, color, national

origin, or sex in the performance of

the contract. DOT 49 CFR Par 26

Disadvantaged Business Enterprise

General

The Minot International Airport (Air-

port), located in the City of Minot,

Ward County, North Dakota, is re-

Selection of the Consultant

It is the intent of the Airport to form a

committee to review the Statements

of Qualifications submitted and rank

the qualified firm(s). Members of the

selection committee may consist of

Airport Staff, City Staff to include

Department Heads, City Council

Members, and others.

The Airport may choose to interview

a shortlist of consultants before

making the selection. The shortlisted

consultants shall be notified at least

7 days prior to the interview date.

All unsuccessful firms will be notified

in writing no later than 10 days after

selection of the Consultant and may

contact the Airport for debriefing.

The Airport reserves the right to re-

ject any and all submissions to this

RFQ, request clarification, or waive

informalities/technicalities, if it is

deemed in the best interest of the

Airport. The Airport assumes no

responsibility for costs incurred in

responding to this RFQ. All submit-

tals to this RFQ become property of

the Airport.

In accordance with FAA selection

procedures, all selections will be

qualification based. No overhead

rate, fees, or any cost information

should be identified as part of this

submission.
